TERMS AND CONDITIONS OF SALE – EMMOTTS OF COLNE LTD
These terms and conditions apply to all sales unless otherwise agreed in writing.
1. Nature of Goods
Most vehicles and parts supplied by Emmotts of Colne Ltd are used auto-salvage parts. These items are not reconditioned or new unless explicitly stated on the invoice.
Due to the nature of salvage parts:
Items may show signs of wear and tear consistent with age and use
Full testing or inspection may not always be possible prior to sale
Nothing in this clause affects your statutory rights under the Consumer Rights Act 2015. All goods must be as described, of satisfactory quality (taking into account their age, price, and condition), and fit for purpose where applicable.
2. Product Selection and Compatibility
We will make reasonable efforts to supply the correct part requested. However, due to variations in make, model, and production year, the customer is responsible for ensuring compatibility.
Customers are strongly advised to:
Provide part numbers where possible
Supply images or bring a sample for comparison
If an incorrect part is ordered:
We may, at our discretion, offer an exchange or refund
Returns must be requested within 30 days of invoice
Items must be returned in original condition
For distance sales (online, phone, email), your cancellation rights under the Consumer Contracts Regulations 2013 apply (see Clause 6).
3. Returns and Refunds
Faulty or Incorrectly Supplied Goods
If a part is faulty or incorrectly supplied, we will offer a repair, replacement, or refund in accordance with your rights under the Consumer Rights Act 2015.
Faults must be reported within a reasonable time of discovery
Items must be returned within 30 days of invoice for a full refund where applicable
Proof of purchase is required
Non-Faulty Goods (Change of Mind or Incorrect Orders)
Returns may be accepted at our discretion
A deduction may be made for any loss in value resulting from handling beyond what is necessary to establish the nature and function of the goods
Carriage costs are non-refundable unless the item is faulty or incorrectly supplied
Electrical Items
Electrical components (e.g. ECUs, infotainment systems) are non-returnable unless faulty or not as described. Customers must ensure compatibility before purchase.
4. Warranty / Guarantee
All parts are supplied with a 1-month warranty from the date of invoice (unless otherwise stated, excluding service items such as gaskets, seals, and belts).
This warranty is in addition to, and does not affect, your statutory rights.
To qualify for warranty claims:
The original receipt must be provided
Parts must be returned in the condition supplied
Parts must not have been tampered with, dismantled, or modified beyond normal installation
For engines and gearboxes:
Must be installed with appropriate new service components (e.g. timing belt/chain where applicable)
Must be filled with correct oils to manufacturer specifications
We may refuse a warranty claim where a fault is clearly caused by:
Incorrect installation
Misuse, neglect, or modification
Failure to follow reasonable fitting or maintenance practices
We recommend installation by a qualified technician, particularly for complex components.
5. Liability
We shall not be liable for:
Labour costs associated with fitting, removal, or refitting of parts
Any indirect or consequential losses (including loss of vehicle use), except where required by law
This does not exclude liability for:
Death or personal injury caused by negligence
Fraud or fraudulent misrepresentation
Any rights that cannot legally be excluded
6. Distance Selling (Cooling-Off Rights)
For purchases made online, by phone, or by email, you have the right to cancel your order within 14 days of receiving the goods under the Consumer Contracts Regulations 2013.
Goods must be returned within 14 days of cancellation
Return costs are the responsibility of the customer
Items must be in original condition
We may reduce the refund to reflect any loss in value caused by unnecessary handling.
7. Delivery and Risk
Customers should inspect goods upon delivery.
If damage is visible:
It should be reported to the carrier and to us as soon as possible
Nothing in this clause affects your statutory rights regarding goods damaged in transit.
Glass items are particularly fragile and should be handled and inspected with care.
8. General
These terms are intended to comply with UK consumer law, including the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013.
If any provision is found to be unenforceable, the remaining terms shall remain in effect.
These terms apply primarily to consumer transactions. Different terms may apply to business-to-business sales, subject to applicable law.
